What Happens After a Foreclosure Sale?

Tax Deed or Mortgage foreclosures are sold at auctions due to unpaid taxes or mortgages. The opening bid at this auction is for the amount of taxes or mortgage that is owed.

When a property sells for more than the foreclosure debt, taxes, liens, and authorized expenses, surplus funds may remain for the former owner or other eligible claimants. Although notices may be sent, they do not always reach the rightful recipient, and many people remain unaware that funds may be available.

We begin with a preliminary review to confirm the availability of the surplus funds, verify ownership information, and identify known liens or other recorded interests that may affect the claim.

This initial verification helps us determine what may need to be addressed as we prepare your claim. Even if judgments, liens, condo liens, multiple mortgages, or bankruptcy are involved, it may still be possible to recover your funds.

Prepare Documents

Our team coordinates the required claim documentation and advances applicable filing fees, relieving our clients of upfront costs associated with filing the claim.

When court petitions, hearings, motions, or other legal proceedings are required, our licensed attorney partners prepare the appropriate legal pleadings and provide the necessary legal representation.

Open Claim & Filing

Before filing, our team performs a more comprehensive title search to confirm lien priority, rightful ownership, and any additional claims or recorded interests that may affect the surplus. This final review also allows us to identify matters that may not have appeared during the preliminary verification or that were recorded afterward.

Once the title review and required documentation are complete, the appropriate claim or petition is filed with the court, county, or agency, formally initiating the recovery process.

After filing, our team monitors the claim throughout the review process and follows its progress with the appropriate court, county, agency, or other involved parties.

We address additional documentation or administrative requirements as they arise and keep you informed of important developments through approval.

Once your claim is approved, the agency, county, or court holding the funds authorizes payment. We’ll keep you informed and explain the final disbursement arrangements.

We'll contact you with that information and issue a check based on the agreed terms in our contract.
