What Happens After a Foreclosure Sale?
Tax-deed and mortgage foreclosures involve properties sold at auction because of unpaid taxes or mortgage debt.
When a property sells for more than the foreclosure debt, taxes, liens, and authorized expenses, surplus funds may remain for the former owner or other eligible claimants. Although notices may be sent, they do not always reach the rightful recipient, and many people remain unaware that funds may be available.

Submitting Your Claim


Once we receive your signed Letter of Representation, we begin by verifying the available funds, reviewing title, lien information, and confirming document requirements including notarizations for your claim. This verification must be completed before we can move forward with the claim preparation.
We gather the required forms and supporting documentation, provide any paperwork requiring notarization, and coordinate notary arrangements. Once returned, all completed documents are reviewed before submission.
After we receive your completed documents, including any required notarized paperwork, our claims processor reviews the appropriate paperwork for submission.
Once initial verification is complete, we’ll provide any additional documents required for your claim. When your paperwork requires notarization, we’ll arrange for a notary. After we receive your completed notarized documents, our claims processor will review the appropriate paperwork for submission. When legal assistance is needed we coordinate with our attorney partners.
Before filing, our team performs a more comprehensive title search to confirm lien priority, rightful ownership, and any additional claims or recorded interests that may affect the surplus. This final review also allows us to identify matters that may not have appeared during the preliminary verification or that were recorded afterward.
Once the title review and required documentation are complete, the appropriate claim or petition is filed with the court, county, or agency, formally initiating the recovery process.

Processing times vary by jurisdiction and case complexity. Many claims are completed within approximately 30–90 days; however, some may take three to six months or longer.

This agreement allows our company to communicate and assist with your claim. It explains our services. representation, and contingency-based payment structure. There are no upfront costs---we are paid only after a successful recovery.
Authorization (When Required)
This paperwork gives us permission to communicate with the agencies involved, request information, and assist with processing your claim.
Limited Power of Attorney (When Required)
This paperwork gives us limited authority to complete specific tasks related to your claim. It applies only to the claim and does not give us control over your other personal or financial matters.
Assignment of Interest in Foreclosure Sale Excess Proceeds
This agreement assigns a specified interest in the excess proceeds according to the terms stated in the paperwork.
Letter of Direction
This letter identifies the parties involved and instructs the agency on how to release. It helps ensure the payment is issued correctly and prevents unnecessary processing delays. Once payment is received, we send your portion within approximately 10 days.
Affidavit of Heirship (For Heirs Only)
This sworn statement is used when the original property owner passed away without a will. It helps confirm rightful heirs and establishes eligibility to claim the funds.
